PEDOMAN PEMBERITAAN MEDIA SIBER

Kemerdekaan berpendapat, kemerdekaan berekspresi, dan kemerdekaan pers adalah hak asasi manusia yang dilindungi Pancasila, Undang-Undang Dasar 1945, dan Deklarasi Universal Hak Asasi Manusia PBB. Keberadaan media siber di Indonesia juga merupakan bagian dari kemerdekaan berpendapat, kemerdekaan berekspresi, dan kemerdekaan pers.

Media siber memiliki karakter khusus sehingga memerlukan pedoman agar pengelolaannya dapat dilaksanakan secara profesional, memenuhi fungsi, hak, dan kewajibannya sesuai Undang-Undang Nomor 40 Tahun 1999 tentang Pers dan Kode Etik Jurnalistik. Untuk itu Dewan Pers bersama organisasi pers, pengelola media siber, dan masyarakat menyusun Pedoman Pemberitaan Media Siber sebagai berikut:

1. Ruang Lingkup

a. Media Siber adalah segala bentuk media yang menggunakan wahana internet dan melaksanakan kegiatan jurnalistik, serta memenuhi persyaratan Undang-Undang Pers dan Standar Perusahaan Pers yang ditetapkan Dewan Pers.

b. Isi Buatan Pengguna (User Generated Content) adalah segala isi yang dibuat dan atau dipublikasikan oleh pengguna media siber, antara lain, artikel, gambar, komentar, suara, video dan berbagai bentuk unggahan yang melekat pada media siber, seperti blog, forum, komentar pembaca atau pemirsa, dan bentuk lain.

2. Verifikasi dan keberimbangan berita

a. Pada prinsipnya setiap berita harus melalui verifikasi.

b. Berita yang dapat merugikan pihak lain memerlukan verifikasi pada berita yang sama untuk memenuhi prinsip akurasi dan keberimbangan.

c. Ketentuan dalam butir (a) di atas dikecualikan, dengan syarat:

1) Berita benar-benar mengandung kepentingan publik yang bersifat mendesak;

2) Sumber berita yang pertama adalah sumber yang jelas disebutkan identitasnya, kredibel dan kompeten;

3) Subyek berita yang harus dikonfirmasi tidak diketahui keberadaannya dan atau tidak dapat diwawancarai;

4) Media memberikan penjelasan kepada pembaca bahwa berita tersebut masih memerlukan verifikasi lebih lanjut yang diupayakan dalam waktu secepatnya. Penjelasan dimuat pada bagian akhir dari berita yang sama, di dalam kurung dan menggunakan huruf miring.

d. Setelah memuat berita sesuai dengan butir (c), media wajib meneruskan upaya verifikasi, dan setelah verifikasi didapatkan, hasil verifikasi dicantumkan pada berita pemutakhiran (update) dengan tautan pada berita yang belum terverifikasi.

3. Isi Buatan Pengguna (User Generated Content)

a. Media siber wajib mencantumkan syarat dan ketentuan mengenai Isi Buatan Pengguna yang tidak bertentangan dengan Undang-Undang No. 40 tahun 1999 tentang Pers dan Kode Etik Jurnalistik, yang ditempatkan secara terang dan jelas.

b. Media siber mewajibkan setiap pengguna untuk melakukan registrasi keanggotaan dan melakukan proses log-in terlebih dahulu untuk dapat mempublikasikan semua bentuk Isi Buatan Pengguna. Ketentuan mengenai log-in akan diatur lebih lanjut.

c. Dalam registrasi tersebut, media siber mewajibkan pengguna memberi persetujuan tertulis bahwa Isi Buatan Pengguna yang dipublikasikan:

1) Tidak memuat isi bohong, fitnah, sadis dan cabul;

2) Tidak memuat isi yang mengandung prasangka dan kebencian terkait dengan suku, agama, ras, dan antargolongan (SARA), serta menganjurkan tindakan kekerasan;

3) Tidak memuat isi diskriminatif atas dasar perbedaan jenis kelamin dan bahasa, serta tidak merendahkan martabat orang lemah, miskin, sakit, cacat jiwa, atau cacat jasmani.

d. Media siber memiliki kewenangan mutlak untuk mengedit atau menghapus Isi Buatan Pengguna yang bertentangan dengan butir (c).

e. Media siber wajib menyediakan mekanisme pengaduan Isi Buatan Pengguna yang dinilai melanggar ketentuan pada butir (c). Mekanisme tersebut harus disediakan di tempat yang dengan mudah dapat diakses pengguna.

f. Media siber wajib menyunting, menghapus, dan melakukan tindakan koreksi setiap Isi Buatan Pengguna yang dilaporkan dan melanggar ketentuan butir (c), sesegera mungkin secara proporsional selambat-lambatnya 2 x 24 jam setelah pengaduan diterima.

g. Media siber yang telah memenuhi ketentuan pada butir (a), (b), (c), dan (f) tidak dibebani tanggung jawab atas masalah yang ditimbulkan akibat pemuatan isi yang melanggar ketentuan pada butir (c).

h. Media siber bertanggung jawab atas Isi Buatan Pengguna yang dilaporkan bila tidak mengambil tindakan koreksi setelah batas waktu sebagaimana tersebut pada butir (f).

4. Ralat, Koreksi, dan Hak Jawab

a. Ralat, koreksi, dan hak jawab mengacu pada Undang-Undang Pers, Kode Etik Jurnalistik, dan Pedoman Hak Jawab yang ditetapkan Dewan Pers.

b. Ralat, koreksi dan atau hak jawab wajib ditautkan pada berita yang diralat, dikoreksi atau yang diberi hak jawab.

c. Di setiap berita ralat, koreksi, dan hak jawab wajib dicantumkan waktu pemuatan ralat, koreksi, dan atau hak jawab tersebut.

d. Bila suatu berita media siber tertentu disebarluaskan media siber lain, maka:

1) Tanggung jawab media siber pembuat berita terbatas pada berita yang dipublikasikan di media siber tersebut atau media siber yang berada di bawah otoritas teknisnya;

2) Koreksi berita yang dilakukan oleh sebuah media siber, juga harus dilakukan oleh media siber lain yang mengutip berita dari media siber yang dikoreksi itu;

3) Media yang menyebarluaskan berita dari sebuah media siber dan tidak melakukan koreksi atas berita sesuai yang dilakukan oleh media siber pemilik dan atau pembuat berita tersebut, bertanggung jawab penuh atas semua akibat hukum dari berita yang tidak dikoreksinya itu.

e. Sesuai dengan Undang-Undang Pers, media siber yang tidak melayani hak jawab dapat dijatuhi sanksi hukum pidana denda paling banyak Rp500.000.000 (Lima ratus juta rupiah).

5. Pencabutan Berita

a. Berita yang sudah dipublikasikan tidak dapat dicabut karena alasan penyensoran dari pihak luar redaksi, kecuali terkait masalah SARA, kesusilaan, masa depan anak, pengalaman traumatik korban atau berdasarkan pertimbangan khusus lain yang ditetapkan Dewan Pers.

b. Media siber lain wajib mengikuti pencabutan kutipan berita dari media asal yang telah dicabut.

c. Pencabutan berita wajib disertai dengan alasan pencabutan dan diumumkan kepada publik.

6. Iklan

a. Media siber wajib membedakan dengan tegas antara produk berita dan iklan.

b. Setiap berita/artikel/isi yang merupakan iklan dan atau isi berbayar wajib mencantumkan keterangan “advertorial”, “iklan”, “ads”, “sponsored”, atau kata lain yang menjelaskan bahwa berita/artikel/isi tersebut adalah iklan.

7. Hak Cipta

Media siber wajib menghormati hak cipta sebagaimana diatur dalam peraturan perundang-undangan yang berlaku.

8. Pencantuman Pedoman

Media siber wajib mencantumkan Pedoman Pemberitaan Media Siber ini di medianya secara terang dan jelas.

9. Sengketa

Penilaian akhir atas sengketa mengenai pelaksanaan Pedoman Pemberitaan Media Siber ini diselesaikan oleh Dewan Pers.

CYBER MEDIA NEWS COVERAGE GUIDELINES

The Freedom of speech, freedom of expression, and freedom of the press are human rights which are protected by The State Ideology Pancasila, the Indonesian Constitution of 1945, and the Universal Declaration of Human Rights. The existence of cyber media in Indonesia are also part of freedom of speech, freedom of expression, and freedom of the press.

The Cyber media has special characteristics; therefore, guidelines are necessary to ensure that its management can be implemented in a professional manner, fulfilling the functions, rights and obligations under the Law No. 40 of 1999 of the Press and The Journalism Code of Ethics.
For that reason, the Press Council jointly withother press organizations, cyber media managers, and the general public decided toformulate the Cyber Media News Coverage Guidelines as follows:

1. Scope

a. Cyber media is any form of media that uses the Internet and doing journalistic activities, in accordance with the Press Law and the Standards for Press Companies established by the Press Council.

b. User Generated Content is any content created or published by users of cyber media, such as, articles, pictures, commentary, voice, video and uploaded forms which are attached to the cyber media, such as blogs, forums, reader’s or viewer’s comments, and other forms.

2. Verification and newsbalance
   a. In principle, each story has to be verified.
   b. News that may harm certain party should be verified within the same news to comply with the principle of accuracy and balancing.
   c. The provisions in item (a) above may be waived, on condition that:

1) The News contains information of public urgency;
2) The first source of news is clearly an identified, credible and competent source;
3) The whereabouts of the should be confirmed news subjectis not known and/or cannot be interviewed;
4) The media explains to the readers that the news still needs further verification, and such verification will be made as soon as possible. The explanation should be included at the end of the same story, in parentheses, and initalics.

d. After loading the news in accordance with clause (c), the media must continue its efforts to verify the news, and once such verification is obtained, it should be listed as a news update with a link to the previous unverified news.

3. User Generated Content
   a. The Cyber media must announce the terms and conditions of User Generated Content which should not violate the Law No. 40 of 1999 of the Press and the Journalism Code of Ethics, and such announcement should be visibly placed.
   b. The Cyber media obliges each user to register for membership and should go through a log-in process to be able to publish all forms of user generated content. Provisions on the log-in procedure shall be formulated further.
   c. In the registration, the cyber media requires all users to give a written approval that the User Generated Content to be published:

1) Does not contain content of a lie, slander, and of sadistic and obscene nature;
2) Does not contain content of prejudice and hatred towards certain ethnicity, religion, race, and community, and does not encourage acts of violence;
3) Does not discriminate on the basis gender and language, and does not disrespect the dignity of the weak, the poor, and the mentally or physically disabled or handicapped.

d. The Cyber media reserve the right to edit or delete the user generated content that is deemed in violation to item (c).
e. The Cyber media shall provide a complaint mechanism for the User Generated Content which was deemed in violation to the provisions in point (c). Such mechanism must be easily accessible to the users.
f. The Cyber media must edit, delete, and perform any necessary corrections to the User Generated Content which was reported to have violated the provisions of item (c), proportionally and as soon as possible within no later than 2 x 24 hours after such report is received.
g. The Cyber media that have complied withthe provisions in items (a), (b), (c), and (f) is not responsible for liabilities caused by the loading of content that violates the provisions of item (c).
h. The Cyber media shall be responsible for the User Generated Contents which has been reported but has carried out the correction required within the period as stipulated in item (f).

4. Rectification, Correction, and the Right to Reply
   a. Rectifications, corrections, and the right to reply are referred as stipulated in the Press Law, the Code of Journalistic Ethics, and the Guidelines to the Right to Reply established by the Press Council.
   b. Rectifications, corrections and or the right to reply should be referred to the news which the rectifications, corrections, or the right to reply are intended to.
   c. For each rectification, correction or the right to reply, it should also be included the time of the publication of related rectification, correction or the performance of the right to reply.
   d. If a particular cyber media news is disseminated by other cyber media, then:

1) The responsibility of cyber media producing the news is limited to news published in its cyber media or other cyber media which is under its technical authority;
2) Correction to the news carried out by theoriginal cyber media, should also be performed by the other citing cyber medias;
3) The media, who is disseminating the news originated from a cyber-media and did not performed the necessary corrections to the news as it is performed by the original cyber media or news generator, then the media is fully responsible for all legal consequences of the news which was not corrected.

e. In accordance with the Press Law, cyber media which does not accommodate the right to reply is punishable with a fine of maximum Rp500.000.000 (five hundred million rupiahs).

5. Revocation of News

a. News that has been published cannot be revoked on reasons of censorship by any parties except bythe editor, unless it is related to prejudice and hatred towards certain ethnicity, religion, race, and community,on grounds of indecency, the future of children, traumatic experiences of victims or other considerations that shall be determined the Press Council.
b. Other cyber media are obliged to follow the removal of the same news which was cited from the original media where the news has been revoked.
c. The revocation of news should be accompanied by a public announcement on the reasons for such revocation.

6. Advertisement

a. Cyber media must clearly distinguish between news and advertisement.
b. Any news / articles / content which is in actual are advertisement or paid content should carry the description of “advertorial”, “advertisement”, “ads”, “sponsored” or other words explaining that the news / article / content is an advertisement.

7. Copyright
   The Cyber media must respect the copyrights as governed by other laws and regulations.
8. Inclusion Guidelines
   The Cyber media should visibly include this Cyber Media news coverage guidelines.
9. Dispute
   Any dispute arising from the implementation of this Cyber Media news coverage guidelines shall be resolved by the Press Council.
